Public Access Terminal Acceptable Use Policy

 

These regulations apply to users of all IT facilities owned, leased or hired by North Ayrshire Library and Information Service (NALIS).

USE OF PUBLIC ACCESS TERMINALS

Our aim is to make available to our users as wide a range of information as possible, including free, filtered Internet access. Use of the IT facilities is restricted to members of NALIS. Membership is free and open to anyone living or working within North Ayrshire. Persons under 16 who are library members may use this service with the written consent of a parent or guardian. Consent forms are available from the librarian. Children under 10 may not use public access terminals unaccompanied at any time. NALIS accept no responsibility for materials accessed by persons under 16 which may be considered unsuitable by a parent or guardian. Further, NALIS cannot take responsibility for materials accessed by other users at adjacent terminals although guidelines are in place to maintain standards of decency. Parents or guardians must assume responsibility for guiding young people in their use of the Internet and other resources.

 

LEGAL PROVISIONS

The use of IT facilities is subject to various legislative provisions, including the Data Protection Act 1998, Computer Misuse Act 1990 and Human Rights Act 1998. Users must also comply with any regulations and instructions displayed alongside IT facilities or as directed by the library staff from time to time.

 

DAMAGE TO NALIS EQUIPMENT AND SOFTWARE

Users must not in any way deliberately cause any form of damage to NALIS computing equipment or software. The term �damage� includes modification or reconfiguration of hardware and software which, whilst not permanently harming the hardware or software, incurs time and/or cost in restoring the system to its original state. The user will be held liable for payment of any such costs.

 

ACCESS TO MATERIALS AND TRANSMISSION OF INFORMATION

NALIS accept no responsibility for the nature of information and data accessed and retrieved on the Internet, nor do they warrant the accuracy of such material. This includes links from ONLINE, the NALIS website intended to facilitate Internet search. Filtering systems are in place to protect users, but this does not amount to a guarantee by NALIS that all undesirable information will be blocked. The user acknowledges that the Internet is not a secure medium and disclosure of personal information, including bank details over the Internet is at the user�s own risk. NALIS accept no responsibility for the consequences of any such transmission of information.

 

VIRII AND OTHER NUISANCE FILES

Material downloaded from the Internet may contain virii or other forms of nuisance file. NALIS accepts no responsibility or liability for any claim, loss or damage whatsoever caused to any external PC or data by transfer of such nuisance files via disk or any other medium. Users must not deliberately introduce any virus, worm, trojan horse or other nuisance program or file onto any system internal or external to NALIS or take deliberate action to circumvent anti-virus software or other precautionary measures undertaken by NALIS.

 

COPYRIGHT

Use of the IT facilities are subject to international copyright provisions. In particular, users must not copy files or applications of any sort using CD writers or any other hardware device without permission from the designated authority.

 

USE OF PEN DISKS AND OTHER PERSONAL HARDWARE

Users may connect personal hardware, such as digital cameras or pen disks into the Library network at the discretion of the Librarian. NALIS accept no responsibility for problems relating to such use of personal hardware, including any loss or damage to equipment resulting from such connection.

 

INAPPROPRIATE MATERIAL

Users must not attempt to store, produce, transmit, copy, access or display material which may be considered to be offensive. This may include text or images of a sexual, pornographic, obscene, defamatory or illegal nature, or any material likely to cause distress or offence to others. What is considered offensive will, subject to law, be at the sole discretion of the Librarian. NALIS accept no responsibility for material accessed or transmitted by users in accordance with the above provisions.

 

ADDITIONAL SERVICES

The use of certain facilities, such as printing, may be charged. Failure to pay outstanding charges may result in withdrawal of services.

 

From time to time, computer and network malfunctions may prohibit access to the Internet or to public access terminals. NALIS will endeavour to keep such disruption to a minimum but accept no responsibility for the malfunctioning of any equipment or software, failure in security or integrity of any stored program or data or for any loss alleged to have been caused whether by defect in the resources or by act or neglect of NALIS.

 

Users must respect the rights of others and should conduct themselves in a quiet and orderly manner when using IT facilities.

 

CONTRAVENTION OF ACCEPTABLE USE POLICY

The use of NALIS IT facilities will be monitored to ensure compliance with these regulations. In particular, members of the Library staff will be entitled, on request, to view computer screens at any time during a session. Failure to observe the regulations may result in the following procedures being invoked:

 

(i) Verbal or written warnings may be given

(ii) Withdrawal of access to IT facilities

(iii) More serious offences may be reported
